I.   Scope of this Privacy Policy

This Privacy Policy describes the types of personal information Mignonne Gavigan, LLC (“Company” or “we” or “our”) may collect through www.mignonnegavigan.com (this “Site”), and how we collect, use, disclose, and otherwise process that information.  This Privacy Policy does not govern our collection of information through any website or other means, other than through this Site.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information. By using this Site, you explicitly accept and consent, without limitation or qualification, to our practices surrounding the collection, use, and disclosure of your information in the manner described in this Privacy Policy.  If you do not agree with the terms of this Privacy Policy, please do not access, browse, or use this Site.

A.  Information You Provide to Us

We collect information about you when you provide it to us. For example, you may be asked to provide personal information to register as a user of this Site, to submit information or request information from us, or to use the services or purchase products offered through this Site.  This information may include:

  • Contact information such as your name, address, email address, telephone number, or other demographic information.
  • Payment information such as your credit/debit card number, credit/debit card expiration date, credit/debit card type, and billing name and address in order to qualify and bill you for any services or products you choose to purchase.
  • Information you provide about your interest in our products and services.
  • Authentication and account information, including your username and password.
  • Any other information you submit when you contact us, including any information you provide through our website “Contact Us” form.
  • Any other information you voluntarily provide.  

B.    Information We Collect Automatically

As you navigate through and interact with our Site, we may also collect certain information automatically through the use of tracking technologies or by other passive means.  This “passively collected” information includes, but is not limited to, the domain name of the website that allowed you to navigate to the Site, search engines used, the internet protocol (IP) address used, the length of time spent on the Site, the pages you looked at on the Site, other websites you visited before and after visiting the Site, the type of internet browser you have, the frequency of your visits to the Site, and other relevant statistics, including the following:

  • Log Information.  When you access the Site, our servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, IP address, browser type, browser language, the date and time of your request, and one or more cookies (small text files containing a string of characters) that may uniquely identify your browser.
  • Links.  The Site may include links in a format that enables us to keep track of whether these links have been followed by IP addresses.  We use this information to improve the quality of our products and design.
  • URLs and Location Data. When you visit or access the Site, we automatically receive the URL of the site from which you came and the site to which you are going when you leave the Site. Additionally, advertisers receive the URL of the page you were on when you click on an ad on the Site. We also receive IP address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system and type of web browser you are using, email patterns, your mobile device and mobile operating system, as well as the name of your ISP or your mobile carrier. We may also receive location data passed to us from third-party services or GPS-enabled devices that you have enabled.

The technologies we may use for this automatic collection of information may include:

  • Cookies.  When you visit or access the Site, we send one or more cookies (small text files containing a string of characters) to your computer that uniquely identifies your browser.  We use cookies to improve the quality of the Site by storing user preferences and tracking user trends.  Most web browsers accept cookies automatically, but can be configured not to do so or to notify the user when a cookie is being sent.  If you wish to disable cookies, refer to your browser help menu to learn how to disable cookies.  Please note that if you disable cookies, you may not be able to use some customized features available through the Site.  We may use cookies and other technologies to collect information about your online activities over time and across third-party websites.
  • Web Beacons.  Web beacons (also known as “pixel tags” or “clear GIFs”) are 1x1 single-pixel graphics that allow us to count the number of users who have visited or accessed the Site and to recognize users by accessing our cookies.  We may employ web beacons to facilitate Site administration and navigation, to track the actions of users of the Site, to compile aggregate statistics about Site usage and response rates, and to provide an enhanced online experience for visitors to the Site.  We may also include web beacons in HTML-formatted e-mail messages that we send to determine which e-mail messages were opened.

You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. While some browsers include a “Do Not Track” (DNT) setting the Site does not currently respond to browser DNT signals.

We do not sell, rent, trade, or otherwise share personal information collected through the Site, except as described below:

  • Subsidiaries and Affiliates.  We may disclose personal information collected through the Site with our subsidiaries and affiliates for the purposes for which you provided the information or as otherwise described in this Privacy Policy.
  • Service Providers.  We work with third parties that provide services on our behalf.  Such services may include, without limitation, product fulfillment, website and email hosting, marketing, website analytics, advertising, and payment card processing services.  We may disclose personal information collected through the Site with these third parties for the purpose of enabling them to provide these services. These parties are bound by contractual obligations to keep your information confidential and use it only for the purposes for which we disclose it to them.

We may use the information gathered to improve web services.  According to Google, Google Analytics employs cookies to define user sessions, which allows for the collection of important data about how users use the Site.  Google Analytics uses only first-party cookies for data analysis.  This means that the cookies are linked to the Site’s website domain(s), and Google Analytics will only use that cookie data for statistical analysis related to your browsing behavior through the Site. According to Google, the data collected cannot be altered or retrieved by services from other domains.  If you so choose, you may be able to opt out by turning off cookies in the preferences settings in your browser.   • Certain Transactions.  We may disclose or transfer personal information or any information collected through the Site to third parties who acquire all or a portion of our business, whether such acquisition is by way of merger, consolidation, or purchase of all or a portion of our stock or assets, or in connection with any bankruptcy or reorganization proceeding brought by or against us.

We may compile personal information and other information collected through the Site on an aggregate basis.  This information may include, without limitation, the number of users who have registered for the Site and demographic information about users of the Site.  Such aggregate information does not identify you individually.  We may use aggregate information and share aggregate information with third parties for any of the purposes specified in this Privacy Policy, or for any other lawful purpose.

Depending on your state or country of residency, you may have certain rights related to your personal information. We will not discriminate against you for exercising any of these rights. 

  • Access and Data Portability. You may confirm whether we process your personal information and access a copy of the personal information we process. To the extent feasible and required by law, data will be provided in a portable format.
  • Correction. You may request that we correct inaccuracies in your personal information that we maintain, taking into account the information’s nature and processing purpose.
  • Deletion. You may request that we delete personal information about you that we maintain, subject to certain exception under applicable law.

This Site is not intended for, and we do not knowingly collect any personal information from, children under the age of 16. If we learn we have collected or received personal information from a child under 16 years of age without verification of parental consent, we will delete that information.

This Site may contain links to various websites that we do not control.  When you click on one of these links, you will no longer be transacting business through this Site.  Third party websites maintain their own privacy policies, and we do not exercise any control over any of the third party websites that may be linked to this Site.  If you visit a website that is linked to this Site, you should consult that website’s privacy policy before providing any personal information.  Please be aware that we are not responsible for the privacy practices of such other websites, and we are not liable for their misuse of personal information about you.

This Site is intended for use by residents of the United States of America only.  All matters relating to this Site are governed by the laws of the State of New York in the United States of America.  If you are located outside of the United States of America and you contact us, please be advised that any information you provide to us will be transferred to the United States of America and that by submitting information, you explicitly authorize such transfer.

We may change or update this Site or any of our policies and procedures from time to time.  We will notify you of any changes by posting the updated Privacy Policy on this Site and indicate when it was most recently updated.  Your continued use of this Site following the posting of an updated Privacy Policy signifies your consent to the changes.

Mobile Terms of Service

The Mignonne Gavigan mobile message service (the "Service") is operated by Mignonne Gavigan (“Mignonne Gavigan”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Mignonne Gavigan’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Mignonne Gavigan through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).   

Mignonne Gavigan's website uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages via SMS.

Collection And Use Of Phone Numbers

When you provide your mobile phone number on our website, we collect it in order to:

  • Send you transactional messages (Such as order confirmations, shipping updates, and account notifications).
  • Provide marketing communications, including promotions, special offers, new product launches, and cart/browse reminders (only if you’ve opted in).
  • Respond to customer service inquiries via SMS if you request communication through text.
  • Text messaging opt-in data and consent will not be shared with any third parties.

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Mignonne Gavigan. Your participation in this program is completely voluntary.  

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to  +1(855)679-0314  or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Mignonne Gavigan mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or service.
